I believe you can direct the Treasurer to put it into anyone's name, provided of course that person consents.

The regulations don't specifically prevent such strategies, and indeed, it is quite clever.  The regulations require that each tender relate to one piece of land, not vice versa.

Nonetheless, the Treasurer does have some leeway if he/she thinks what you've done is unfair:

      22.  (1)  If the treasurer is of the opinion that it is impractical to complete a sale under the Act or to do so would be unfair to the bidders or tenderers, the treasurer may cancel the sale and conduct a new sale under the Act.  O. Reg. 181/03, s. 22 (1).

This is not legal advice.  If you would like legal advice, you'll have to pay my retainer.  ;0)

Questions and Answers / Re: Where is my nearest Land Registry Office and what services does it provide?
« on: December 11, 2006, 05:00:30 PM »
If anyone needs help doing searches, give me a ring (416.837.6725).  I recently got hooked up with e-reg and it's an absolute time saver (I'm a lawyer, that's how I got it).  The only problem is that it charges $18 for parcel abstracts, instead of $9 at most Land Registry Offices.  But it has many many LRO's at the touch of a click, so you don't have to drive to Thunder Bay. ;-)  Also because I'm a lawyer, it is illegal for me to bid against you for any properties you show interest in (conflict of interest).

And I read in one of these message boards that people are doing PPSA searches.  Here's some free advice: stop wasting your money with PPSA searches.  Most of the value of your bid is in the land/house.  The Tax dept usually only sells the property - i.e. they aren't giving you a bill of sale for the chattels/fixtures becuase they don't usually exercise that right under the Municipal Act.

"Affordable lawyer" is no longer an oxymoron.  If you need help with your searches, I am hooked up with e-reg and can save you time and the stress of someone overhearing your search.  Call 416.837.6725.
