Heres a story that happened this week that could serve as a warning.  I was the highest bidder on an island in south frontenac.  Soon after,  I went to see it, along with a check to pay the township.  There were some shoreline access issues so I talked to several cottage owners, who were quite territorial about using any land to launch my canoe. But I got to the island, loved it and went and paid.  A week later the treasurer sent me the documents to sign to register the deed. but later the same day he called and said the owners daughter came and paid the back taxes.  Apparently me having talked to several neighbors was the mistake as they contacted the owners family and thats the end of it according to the treasurer even though they already took my check.  So after 20 years of tax sales I got sloppy I needed to relearn the lesson. NEVER TALK TO ANYONE ABOUT THE TAX SALE! even after you won.

Can anyone inform me as to the legality of a municipality posting a tax sale property that  is assessed at, say, $12,880.63, and setting the minimum bid at $190,000? Are they allowed, or required, to set the bid at, or near, current market value?

Greetings my friend Ernie

While the rules may seem screwy,

The municipality can collect all arrears

Including amounts added over the years.

The bigger worry out of that report is the recommendation that Tax Sales list the minimum bid as the actual value (or assessed value I would assume) instead of the taxes owed.  That would pretty much kill the tax sale game.

Alas, I grow weary and old

soon no properties will be sold,

The municipalities will take a big hit

I had a clown bragging about  losing 150 acres in Niagara.  Lost an OMB and then lost the land to taxes and still tried to peacock.  Anyone from Niagara would know Carlo M.

He brags about  coming up with Testamentary lots scheme while serving time for fraud ( Astra Trust).  Jackass also decided to teach the city a lesson and lowered the lots to 175 despite the frontage being 200 for decades.    Had he not tried to scam  with the smaller frontage the city would have let him get away with the scam lot creation.

Loses the OMB  and the lots are still rotting empty after 20 plus years. Was never his money that was lost.

Bizarrely enough he tried to convince me to partner with him. I just had to give him land and money and he would get approval.  He somehow hoped I had not read newspapers or zoning policies for the last 30 odd years.

That clown ain't funny

I could never understand why the people wait to the last minute....they think they are being cute as they are the victim and we are the evil ones ....

I would die of shame and pay it off immediately if it ever happened to me. Instead the entire town knows he is a roach.

I won a tax sale!

However, the municipality did not really know what to do, so it's taken days....

When the town did get back, they did require me to get a lawyer, so I came to the forum and found a recommendation by worldjohn for a lawyer familiar with tax sales.

I went to his office, he explained most of the next steps quickly and efficiently for a reasonable price.

I read the road access act.   It says you cannot block an access road.  These properties were all owned by one owner and they were private trails not an access road.   I don't consider these trails as access as they have legal access via a road allowance.   I have my lawyer ready as I cannot back down from this one as these are my private  hunting grounds and I don't want to see a vehicle drive though during my hunting time.  The other properties are not legally landlocked.

I purchased tax sale land 9 years ago and have lately, new property owners wanting to access their lands through my private trails.   I had recently, a crown attorney harassing me saying this is an access road.  It is my understanding you can deny trespassing on private trails if they have a road allowance available to you.  Trespass law only deems passage possible if you are landlocked and not out of inconvenience or expense. It does not matter if it is unopened and not my problem to give them the red carpet treatment.   Am I correct?   I need help of wolves.

I hope you are keeping well,

Keep in mind this important fact

you would do well to study the Road Access Act,

But there is also the matter of the common law

which just might stick in your craw,

But for sage counsel on your journey

You must speak with a top attorney.

I have no clue how many bids as I logged off for 30 minutes . But I'm guessing well over 50

Winner 810, Second 601  then say a dozen  from 521 to 250 .piles of 160 to 220....then the ridiculous 25 to 75

810 is high if investment or farm pricing but a good deal if this is to be a family home.  1500 ft driveway and you are on top of a 100 ft hill.   There was gas line on the street so you can have a real nice setup.

so I decided to try again at this tax sale property game. I gave up a few years ago when bids started getting truly ridiculous. Im hoping all those people overbidding have gone bankrupt and prices will stabilize.  I still have not gotten my dream hobby farm. south glengarry seemed like a possibility until I saw a lien from the Law Society of Upper Canada c/o ontario legal aid plan.  It seems obvious that its a crown lien but I have been unable to ever find out how much liens like this actually are.  does any one have any shortcuts or tricks how to find out the amount a crown lien actually is?

50 acres on waddell rd looks great until you drive about 1000 feet up the road ...which is also upwind

That massive construction is   a 1200 head pig farm with 125 head of cattle .  The pond they are building is a 1 million gallon storage for the waste.

A 200 head has a setback recommendation of 1/2 mile for smells  so you can imagine how bad this will be

not even mentioning the yummy well water....

1200 is not a number to dread

I'm new to tax sales, but I have experience with rentals and other real estate.  My question is regarding contacting the registered owners of the property that is scheduled to go up for tax sale and entering into an agreement with the owner to purchase the property and pay off the tax lien prior to closing.  Has anyone done this, is this common, are there any pitfalls, drawbacks, legal issues in doing this maneuver?  Has anyone had success doing this?  Thank you all for your responses in advance.

I have always considered one of the key points of this site is to warn people of land mines.  By telling people of serious issues  we eliminate overpayers and hopefully someone warns us of other landmines.

Over the years we have all lost bids to people who overpaid as they didnt know of serious issues.

We obviously do not disclose gold mines to each other but we should warn of the landmines only on the hope that someone will do the same in the future.

I didn't bid on this as I had no interest but  if people knew about the retaining wall it should have been posted.

Just my two cents.....

PFM:

I did warn the wining people only 3 hours after the bids had closed.  They have/had almost 14 and 28 days to decide if they wish to proceed and if not we will all know of their decision if it tenders again next year.
The only thing I did not do was warn people in advance but I did warn them in time to cut their possible losses.  I know of other ways but that is not in the public domain.

Tax sales are a high risk investment and if you cannot afford to lose 20% of your bid you should not be bidding.   As someone I know from another arena
arena once said "If I ain't losing some I ain't bidding it right. (because  I am overpaying.) Yes I have walked away from my deposit also.

I personally have given a lot of warnings and received a lot of flak for them because people have in effect accused me of spreading false news.

Bee:  The Municipality usually will not tell.  Obviously some people knew (I know of at least one other). The big question is how,
but I am not telling because it is part of my art.

Too often we forget the first rule of tax sales.  'Properties appear on tax sales because there is a Problem with the property or the owner'

Second rule:  'Reread rule one'

Unfortunately I think shortly we will have to add a third rule soon,

"Buying tax sales is like buying stocks. Any fool can buy them. The key is what you can sell them for"
